I have some custom figures I have made that I do not play with and would like to trade for other Clix figures.
The figures I have made are mainly Ultimate versions of Marvel characters, for example Ultimate Scarlet Witch on on old IC Scarlet Witch base. I also made most of the rest of the Ultimates team before Wizkidz released their own versions.
Is it OK to list these figures for trade? I will not sell them, only trade them away.
Sure, why not? if someone's willing to trade for them, I don't see why you couldn't. just make sure you list them as Custom clix so no one feels fooled. you also would probably want to link to some photos of them. some customs I've seen are very nice. :)
From the Marvel/DC Copyright thread, in the Artisan's Guild forum, per Typhon (the site owner):
http://www.hcrealms.com/forum/showthread.php?t=4121
DC Comics and Marvel Characters, Inc. retain all copyright, trademark and proprietary rights on all of their characters, names, logos, and distinctive likenesses thereof which may not be reproduced, transmitted, distributed, publicly performed or displayed or used in any manner for commercial or promotional purposes. WizKids cannot and does not grant permission to any individual/website owner to sell or trade customized HeroClix units on their websites or elsewhere.
If you are found attempting to sell or trade "customized HeroClix units", we will remove you from our site.
So no, HCRealms may not be used as a forum to trade custom Heroclix figures. Sorry!
Oops. guess i was telling him to break the law. "breaking the law, breaking the law." :p Sorry. :nervous:
It's all right. That post really should have a copy in the trading forum as well- it's not obvious unless you know where to look for it. Y'know what? I'll put a copy in right now.

Relax.
It's not breaking the law per se. It's only a copyright violation if you use someone else's intellectual property for commercial purposes (which includes marketing). Which is why HCRealms can have a mods forum, as modding itself is within "fair use" of the property.
Some types of barter are legally not considered to be commercial. The problem with supporting mod trading is that HCRealms has no desirable way (i.e. no way that is worth the effort) to monitor the transactions to check for commercial status.
I like the Judas Priest reference, though. Haven't heard that song in a long time...

You could always trade for figs, then "throw in" an extra freebie custom. Right? Shouldn't be anything wrong in giving them away...
