It is very important you read this entire message before posting.
By posting in this forum, you are agreeing to the following rules. If you do not agree with these rules, or feel that you cannot abide by them, do not post. A single post signifies your agreement to these rules.

HCRealms Neutral Ground Forum Usage Agreement

1. We may amend this Agreement at any time by posting the amended terms on our site. Except as stated below, all amended terms shall automatically be effective 30 days after they are initially posted on our site.

2. Membership Eligibility.
Our services are available only to individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, our services are not available to minors or to temporarily or indefinitely suspended eBay members. If you are a minor, you can use this service only in conjunction with your parents or guardians. If you do not qualify, please do not use our services.

3. HCRealms is a Venue.
3.1 Our site acts as a venue to allow anyone to offer and trade just about anything, at anytime, from anywhere, in a variety of trading formats. We are not involved in the actual transaction between buyers and sellers. As a result, we have no control over the quality, safety or legality of the items advertised, the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to buy items. We cannot ensure that a buyer or seller will actually complete a transaction.
3.2 Identity Verification. We use many techniques to identify our users when they register on our site. However, because user verification on the Internet is difficult, HCRealms cannot and does not confirm each user's purported identity. Thus, we have established a user-initiated feedback system to help you evaluate with whom you are dealing. We also encourage you to communicate directly with potential trading partners through the tools available on our site. You may also wish to consider using a third party escrow service or services that provide additional user verification
3.3 Release. Because we are a venue, in the event that you have a dispute with one or more users, you release HCRealms (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. If you are a California resident, you waive California Civil Code §1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."
3.4 Information Control. We do not control the information provided by other users that is made available through our system. You may find other user's information to be offensive, harmful, inaccurate, or deceptive. Please use caution, common sense, and practice safe trading when using our site. Please note that there are also risks of dealing with underage persons or people acting under false pretense. Additionally, there may also be risks dealing with international trade and foreign nationals.

4. Listing and Selling.
4.1 Listing Description. You must be legally able to trade the item(s) you list on our site. You must describe your item and all terms for trade on the Trading Forum of our site. Your listings may only include text descriptions and other content relevant to the trade of that item.
4.2 Fraud. Without limiting any other remedies, HCRealms may suspend or terminate your account if we suspect that you (by conviction, settlement, insurance or escrow investigation, or otherwise) have engaged in fraudulent activity in connection with our site.


5. Restricted Activities.
Your Information (or any items listed) and your activities on the site shall not: (a) be false, inaccurate or misleading; (b) be fraudulent or involve the sale of counterfeit or stolen items; (c) infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy; (d) violate any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, antidiscrimination or false advertising); (e) be defamatory, trade libelous, unlawfully threatening or unlawfully harassing; (f) be obscene or contain child pornography or, if otherwise adult in nature or harmful to minors; (g) contain any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information; (h) create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers; and (i) link directly or indirectly to or include descriptions of goods or services that: (aa) are prohibited under this Agreement; or (bb) you do not have a right to link to or include. Furthermore,
5.1 License. Solely to enable HCRealms to use the information you supply us with, so that we are not violating any rights you might have in that information, you agree to grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable (through multiple tiers) right to exercise the copyright, publicity, and database rights (but no other rights) you have in Your Information, in any media now known or not currently known, with respect to Your Information. HCRealms will only use Your Information in accordance with our Privacy Policy.

6. Feedback.
By posting a trade in the Trade Forum you agree to allow other HCRealms members to post feedback for you in either the Good Traders or Bad Traders Forum, and accept that those posts may be positive or negative. You understand that the only way a "Bad Trader" listing can be removed is at the request of the original poster. Any attempt to threaten HCRealms, any HCRealms member or owner, or employee to have this feedback removed will cause your access to all RealmWorx, LLC sites to be removed permenantly.
6.1 Integrity. You may not take any actions that may undermine the integrity of the feedback system. If you recieve 3 or more complaints in the Bad Traders forum in 90 days or less, your membership may be suspended, and your access to the Neutral Ground Forum or HCRealms as a whole may be removed.


7. Breach.
Without limiting other remedies, we may immediately remove your item listings, warn our community of your actions, issue a warning, temporarily suspend, indefinitely suspend or terminate your membership and refuse to provide our services to you if: (a) you breach this Agreement or the documents it incorporates by reference; (b) we are unable to verify or authenticate any information you provide to us; or (c) we believe that your actions may cause financial loss or legal liability for you, our users or us.


8. No Warranty.
WE, OUR SUBSIDIARIES, EMPLOYEES AND OUR SUPPLIERS PROVIDE OUR WEB SITE AND SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. WE, OUR SUBSIDIARIES, EMPLOYEES AND OUR SUPPLIERS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. This warranty gives you specific legal rights and you may also have other legal rights that vary from state to state.

9. Liability Limit.
IN NO EVENT SHALL WE, OUR SUBSIDIARIES, EMPLOYEES OR OUR SUPPLIERS BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH OUR SITE, OUR SERVICES OR THIS AGREEMENT (HOWEVER ARISING, INCLUDING NEGLIGENCE).


10. Indemnity.
You agree to indemnify and hold us and (as applicable) our parent, subsidiaries, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party.

11. Legal Compliance.
You shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of our service and your listing, purchase, solicitation of offers to trade, and trade of items.

What's it mean?
Now that you have read the long legal, here is the important parts. With this system, if you post in Tradeing forum, you agree to all of it. If you post for a trade in the Trading Forum, other users can now post about you in the Good or Bad Traders forum.

We encourage your to start your own Good Traders Post!
Feel free to start your own Good Traders Post. Simply make the subject "Username - Good Trader". You can then link to it in your signature, email it to people you've traded with, or send it in PMs. People you have traded with can then go and put a response in your thread. Your post count on your thread will be a good indicator for your trade history.

You can now post "bad" feedback in the Bad Traders Post.
With exceptions. You can only post bad feedback for the person if they have posted in the Trading Forum. Please realize that the person you are posting on will have the opportunity to comment back. It is important that all posts remain civil. We *strongly* encourage you to try and resolve your issues before you post a "Bad Trader report". The only way a Bad Traders post can be removed is to have the original poster report it and ask for it to be removed. Otherwise it will not be removed. All "Bad Trader" posts should have the "Bad Trader’s” user name in the subject and a clear description of what has gone wrong in the body. We will *not* investigate these, but it will help others make their decision. Feel free to search for existing posts and add on if you have had problems with the same person.

You cannot threaten HCRealms or HCRealms personnel to have bad information removed.
Any sort of threat will cause your access to be removed and never reinstated. Don't trade on our site if you don't think you can handle this responsibility.

This “feedback” system is for HCRealms users only
We are not eBay, we are not the BCC. If you have had problems with eBay or online venues or other forums (including other RealmWorx, LLC forums) do not post that here, it is out of place!

Hello fellow Realmers

HCRealms is no longer allowing “Grab Bag” type auctions to be run in the Trading Forum.

These auctions have caused a lot of problems and confusion for legitimate traders, and are too easy to manipulate and defraud.

Also, there is a strong enough market for individual figure sales to make Grab Bags auctions unnecessary.

If someone really wants to sell grab bags, we suggest you use an auction site where that type of sale is common.
At HCRealms we’re going to stick with straight trades and sales, and leave the wheeling and dealing to other sites.


Bumping Threads

It seems to be common practice to ‘bump’ your own trade thread to keep it current. But for the consideration of everyone who comes here to trade, please DO NOT bump your threads.

Why?
By bumping your thread you are pushing someone else’s thread down the page. Then in order for them to be seen they have to bump theirs, and so on.
Plus, threads with posts naturally end up at the top, so take it as a small sign that if your thread is falling into obscurity, you might not have trades that people are interested in right now. Consider revising your list, your demands, or simply wait a little while and repost later.

As for legitimate updates, please feel free to update your list and post “updated with:” and list your additions and deletions. As well as editing these changes to your original thread.
This lets people know you have real updates, and aren’t just using the word update in place of ‘bump’.
But please give it a couple of days at least between updates (unless you are vigorously trading), or else constant “updates” will still be viewed as bumping.

We want members to have fun and to have the ability to trade online, but everyone should get an equal chance to have their lists viewed, so please be courteous to others and follow these guidelines.

The fact that I even need to post this addition is rediculous, but it seems some people are not clear on the fundamental concepts of an auction.

Here's the deal, if you post an auction, you are obligated to honor it. There is no such thing as canceling an auction because you think your item sold for too little. If you do not want it to sell for too little, set a minimum bid.
Otherwise you are expected to follow through on all auctions in a timely manner.

Please feel free to report people who do not honor their auctions and their trading privledges may be removed.

A couple additions:

1) If you have a complaint about a previous trade, please restrict your comments to the Bad Traders forum. I know you may want to warn others, but by posting there you've done your duty.

2) If you object to someone's trading demands, please refrain from commenting on their thread. What you consider unacceptable may be fine to someone else, and by posting you've only given them a free bump. Plus, it's far too easy to cross the line into a warning for Provocation or Disrespect.

I wanted to call attention to a portion of the rules here:

4.1 Listing Description. You must be legally able to trade the item(s) you list on our site.

If you do not have the item in your possession, you can not trade or sell it. It's not "yours" yet.

It has been brought to our attention that some Envoys are selling unreleased LE's that they recieve as either prize support and/or Envoy Rewards. If we catch an Envoy doing this, we will remove the thread, issue a 10 point warning and inform WizKids, who can take further action. So please don't do it.

Added rules:

Please keep your trades and sales to HeroClix related items only!

Trades and/or sales that don’t include HC items will be pulled.

Being a HEROCLIX forum, we have to give priority to HC trades.
Non HC trades and sales unfairly bump legitimate threads down the page.

This forum is not a garage sale for people to unload anything and everything.
If you’d like to trade Star Wars for Star Wars, please go to a SW forum.
If you want to sell your video games, try Ebay.

HC *for* SW (or vice versa) is perfectly ok.

(If you’re intentionally trying to abuse the system by putting 1 HC figure on an otherwise all off topic trade/sale, you will get warning points for intentional spamming.)

Just a quick blurb as it has come to my attention. You can not SELL Custom figures as they can and will be considered "counterfit" as they are not tournament legal figures. You must consider copyright on figures that you custom as Marvel, DC and Independent companies own the rights to certain figures.

Another rule that I'm surprised has to be posted here, but oh well...

EFFECTIVE IMMEDIATELY

You cannot trade, buy, or sell weapons of any sort on HCRealms. Anyone caught trying to make any type of exchange involving a weapon will be immediately banned from the Neutral Ground indefinitely.
