Actually When Franklin Died He was able to co opt the phoenix force to keep an artificial Copy alive.

Plenty of folk can deal with that sort of problem. Not reliably so, but unreliable omnipotence still means a chance of getting dead, dead, dead by someone as lowly as the Punisher, when you really get down to it.
