So I bought a bunch of clix from another realms member, and when I got the lot I had some legitimate issues. I got a good deal, but trading rules were broken and I have problems with this as both a buyer and a Mod. Let me just lay out the PM exchange and ask for feedback.
PS - Don't start asking who did the deal, or what the deal was; I want to keep the guy anonymous for now. It's a matter of rules and principles, as I said before it was still a good deal even with the problems.

2 of the SR's (XXXXXX and XXXXXX) do not have their original cards. No mention of this was made in your sale thread.
It is also not a complete set as it is missing X, X and X.
Well the SR and SR I bought never had original cards. I got them for $X each w/o the cards. Copies seemed ok for me. [EDIT: The seller states here that he was unaware that it was not a complete set] When I bought the set, it was sold to me as a 1-48 CUR set and got boxtops and the coupon to send in for BibtB. I then had to pick up all SRs individually. I'm sure I paid over $X to put this collection together.
I thought it was it good deal. Sorry you were disappointed. It was not my intention to deceive.
Also, I did ship it priority and paid for that. Take out the Paypal fee, the set only netted me $X.
It's not about value, it's about selling rules. I'm happy enough with the deal I got in general, but you can't just sell incomplete sets and SR's without original cards without mentioning it then say it was a good deal.
If I sold you E-2 Super for $40 and it didn't have the card you'd still be fully within your rights to complain to me even if it was still a good deal.
Forum selling rule 8:
---Be certain to point out the condition of the figure(s) you are selling BEFORE you sell.
This includes currently broken or mangled pieces, previously broken pieces that have been fixed, figure glued to flight stand, missing character cards, bent cardboard (character cards, feats, bfcs, and bystanders), and factory mistakes (smudged dials and misprints)---
If it was some commons I'd just shrug, but these are SR's; also you knew they had replacement cards but said nothing, so it wasn't just a mistake.
I don't know what we should do about this, but I'm not best pleased as either a buyer or a Mod about the way you handled this sale.
IDK what to say. I'm not big on the cards. Doesn't effect play. To be honest, if roles were reversed, I'd be a little disappointed about the cards but not quite to the point of being as frustrated/angry as you seem to be. Again, not running a con here. Guess I'm not quite as serious about the whole clix thing as some. I enjoy them but I guess I'm not a die hard purist.
If I got an E-2 and not the card, I wouldn't probably complain. In fact, I bought some guys modded Superman with an E-2 dial and a printed card. Liked it as much as if I got the actual chase. That's me.
Again, sorry. [EDIT: The seller points out again that he thought it was a full set, and the listing of a full set that he made was accurate to his knowledge]. I sent you those figures. All of the figures were unplayed. I mailed as soon as possible.
I guess as a Mod if you want to shut me down, flame me or otherwise, I guess I can't stop you. I just wanted to get rid of the figures for some money to buy some old books.
Thoughts as to what I should do/not do?
I really want to be fair in this, and I'm walking a tightrope between buyer and Mod.

I'de have to say your fine with being upset/ticked. I would be to. I'm not really sure what to say to have you do. I believe that even though he is claiming that he didn't know that some were missing and that the cards weren't included he still should have specified that they were printed out cards or just missing. Ignorance isn't an excuse in the law and personally in life. If you claimed to not know that arson was illegal but burned down a school your arse is still going to jail. This doesn't mean I take clix as serious as the law but well actually I kinda do I guess, at least when it comes to trading or buying figures. Not the game rules. thats meant to be fun.

However, 1 card missing, I could see as an oversight. 1 figure missing, ditto. Combine it all together, and it's a right royal cluster gong. I'd be POd myself for sure. Has the seller offered any kind of 'compensation' for their 'mistake'?

Since its a complete set I'd assume its more of a collector thing and needs to be in better than just play condition. The SRs does make it rough as well because that is a higher % of the value.

Despite the faults I feel that the trade was worthwhile (plus shipping costs would be incredibly draining for both sides); really my 2 issues are:
1)As a buyer I'm rankled that when the problems were pointed out, absolutely no offer of restitution at all was made. Whenever I sell I bust my hump to make sure the buyer is satisfied. If I screw up I at the very least toss them a crumb, because it's not their problem that i screwed up.
2) As a Mod I am concerned about a seller using the realms for future deals when they seem so nonchalant about something like this. I have somewhat of a duty to people who sell under my watch.
I'm torn because warning people off of dealing with him feels too harsh, but I also feel like him throwing his arms up and walking away scott free makes me a chump.
It's a real quandary. Frankly I've never dealt with a seller who didn't at least make an effort to make amends, even if it was something trivial.

If not; I would say its fair game to post his name, because if he wants to continue to do business here on HCRealms; he does have to follow guidelines. The trade rules state you have to have full disclosure. That he did not do.
I wouldn't ban/WP him obviously; but I would follow standard practices and see if this can be settled before posting his name.

Agreed. That sums up nicely exactly what I was going to say.
rules are rules d-knight I bet if the roles were reversed your name would be posted all over here. I would have to say that ether he makes good or gets a negative or at least neutral feedback. If I had bought this I would be leaving a negative when I buy a complete set that is what I expect a full set.
I'd offer him one last chance at coming to a resolution.
Him just saying "Sorry"? That's not good enough & doesn't fix the problem that he created.
If (probably when) that failed? Then, regardless of how good a deal it still was, I'd leave him the negitive feedback he's earned.
I'd post his name in the bad trader lists (maybe with an explanation that he's there because of the rules he failed/refused to follow).
I'd also add him to my own personal "Do not deal with again" list.
And in your case in particular, consider;
It's your JOB to enforce the rules. If you don't? Then you're not being an effective Mod.
Besides, the rest of us deserve to know who the bad/questionable traders are. If we choose to deal with them anyways? That's our own problem, but at least we'll do so informed....
my opinion: you still claim that you are ok with the deal. Since he decided not to offer any restitution, I would say that neutral feedback is warranted. I had a couple of problems with a trade (the condition of the figure I sent was not good), and we worked out an alternate. No complaint, he still gave me positive feedback even though I told him neutral would have been justified.
Could you say car salesman?!?!?!? He misrepresented what he was selling. Your choices are
1. Get a partial refund
2. Give negative feedback
3. Send everything back and get a full refund (might have to take this up to paypal if you pay through them)

I linked the seller to this thread to show him that I wasn't just being some kind of anal retentive looking to shake him down. He got back to me with a more than amicable offer to make things right and I'm very happy with the outcome.
Let this be a lesson, folks; it's always worth talking it out and trying to find a mutually satisfactory solution before rubbishing each other.
