I recently bought a set of LE's on E-Bay. The cost was $72 or best offer. Well I made an offer for $65 and was immediately denied another for $67 and again declined. The seller used the deny all bids under this amount option. My final offer was $70. I thought about it and thought what's $3 and hit buy it now. Not 5 minutes later she accepted my offer, must have had more than 1 set actually had 8 for sale total. Well I sent an E-mail saying I only wanted 1 and didn't realize that the offer stood after I bought 1. She said she'd forget about the $70 set if I sent her $7.20. I just went ahead and bought both.
I also bought a Fire/Ice duo. In the auction it stated any additional auctionswould be discounted to $1. Technically the shipping should have been $5 but I was charged $12 for shipping. Worse experience I've ever had with E-Bay. If I wanted to spend $154 I would have bought complete set 3 of each figure and 10 tokens and maps which was on E-Bay at the same time with free shipping.
The seller is top notch so I'm weary of leaving negative feedback. If in my situation what would my fellow realmsers do? I have personally allowed 2 people to retract their bids/sales because of a mistake or misunderstanding. Does E-Bay charge the seller even if the payment isn't made? I don't remember being charged but my E-Bay fees come out of my pay pal automatically so maybe I didn't notice.

You shouldn't of paid. Sellers can't leave negatives anymore so if she won't work with you refuse to pay...

Well it only really seems like she screwed you with the shipping; if she had a combined cost then charged you more, ask for a partial refund and leave negative feedback if she refuses.

A couple things:

If you make an offer on something, retract your offer before using Buy-It-Now, otherwise you will be purchasing both.

Sellers are charged final value fees on any purchased item, whether or no the buyer pays for them. In most cases, they are 12%.

The seller can get a credit for them, but they have to initiate a mutual cancellation of the transaction.

Don't be afraid to leave a negative if it is really warranted, but in this case, I don't believe it is deserved. You can now see how trying to save just a few dollars can turn into some big problems.

If you already paid for both sets, I would just keep the one set when it arrives and trade/sell off the other.

Also, if you bought Web of Spider-Man LE sets, well, you know they are supposedly not for resale anyway, so if that seller is selling them and not using them as prize support, well, they're already doing something wrong (according to Wizkids/NECA).

I would like all the LE pieces immediately myself, but I would rather purchase them from players who won them fair and square, then from stores who had agreed NOT to sell them.

I would use this as a lesson learned, and tread carefully with any online sales from now on, either as a buyer or seller. If you receive both LE sets, you haven't lost anything, other than some cash flow, which you should be able to recoup.

In most cases, I would say DON'T pay unless the shipping and all terms are exactly what you agreed to when you bid or hit the Buy-It-Now button. You can always ask for a reinvoice or shipping clarification BEFORE paying.

Good luck on getting the LE sets you ordered, and really think about the feedback, there is always a Neutral option, or the option not to leave feedback at all. :)

Thanx. I planned on asking for cash back on the shipping since she said she used delivery confirmation but there's no sticker for it also the fact I looked oveer the shipping terms and feel shafted. If she agrees I just won't leave feedback.
About the mutual cancelation option. If we both agreed would she have been charged for the sale? That's the whole reason I agreed. I have received the figures and they were in the same shape as the Daken and Venom figures I won. I shouldn't have bought prize support but I worried I'd have to wait if I placed poorly to get Daken and Venom. I did well and traded for Venom. Now I have 2 extra Dakens and Venoms.

Yeah, if you had both mutually agreed to cancel the transaction, then they would have credited her the Final Value Fee, which is probably the 7.20 she was asking for.

The problem is, sellers don't like to ask, because if you declined the mutual cancellation, she would still have to pay the Final Value Fee.

She would have had to initiate the Cancel Transaction form. She should have done that. Then you would have only been on the hook for the 1 item you actually mean to order.

And honestly, it's not that YOU shouldn't be buying it, in most cases, it's the seller that shouldn't be selling it. They have a contract/agreement with Alliance/Diamond/NECA/Wizkids. You as a consumer, do not. :)

But if you see all the prize kits being sold online, it's obvious that some stores do not follow the policies. :(

When I'm thinking of bidding on multiple items from a seller, I always message them and ask them about combined shipping before bidding or buying. And when buying multiple items from a seller, I always request a total with combined shipping. General rule of thumb when dealing on e-bay for me. ;)

Wow... This woman is lucky it isn't me. Charged for DC but didn't use it. I would file a dispute with paypal and say I never got it. No DC#= I WIN. But I wouldn't do it for the money. Most likely she would empty the account anyway. But she would get what she deserves for not only selling prizes but for trying to get you with her shipping prices.

Try & work it out with the seller.

If no solution can be reached about the shipping fee "errors" that way? Dispute it.
If nothing can be resolved after that? Leave her the negitive she's earned. Keeping her high feedback score unblemished is not your concern - it's hers.

If there is any problem at all - literally any problem, or anything shadey - negative feedback.

There are so many good sellers and traders out there - dont worry about leaving bad feedback.

The fact that she let you change your order though - does mean that the person isn't trying to screw you.

But - if you walk away from the deal saying "that wasn't good" then negative away!

I feel the same way with HCrealms! Luckily everyone here has been PERFECT traders. I haven't had any problem. ANY. As in 0 problems. In fact, I've had better trades here than any ebay purchase.

Dont be afraid to leave negative feedback if there is a reason.

Seller gets charged FVF if item is sold and paid for.

If: Either seller or buyer cancels the transaction seller recoups FVF
If: Buyer does not pay for goods - seller initiates Non-payment procedure - if no response or incomplete transaction -- seller recoups FVF

The only fee the seller loses is LISTING FEE (varies .03 to dollars depending on the value of the item). If it is a store Item (BIN /BO situation) there is no recoup of fee. if it is auction - seller can re-list but pending onthe circumstance may not be worth it. This is still the grey area that EBAY loves - Ebay wins /Seller loses.

As for your circumstances:

It seems like the seller was unresponsive/unco-operative with your circumstance. Most reasonable and intelligent sellers are as much concerned with the potential feedback than just the monetary sale. Having said that a good seller will also guard against potential blackmail.


Unfortunately the seller is in the right when Best Offer is a 2 stage process including CONFIRMATION of your offer. To the seller when viewing the offer(s) sent he may have been thinking you were trying to locate the "sold" stage without a real commitment. Ebay reminds you that you are commited to it. However forcing someone to complete a transaction is USUALLY not a good way of doing business.

Keep the one set you want - sell the other & leave a negative if the seller will not take the return.

BTW- The seller probably had the Best Offer on automatic to reject offers at a certain price point - I wouldn't think they would so rapidly reject an offer otherwise.

The fact that she had every offer rejected all the way up to $2 off made me wonder why she even had that option. I now noticed that 2 of the figures are damaged. The cards are all bent but they probably came from the factory that way.
I was shocked she wouldn't let me out of the second purchase. It was a mistake and that was obvious. I had no idea she had more than the one set left since she had sold 5. She was extremely greedy ordering 3 kits 9 sets plus an extra 21 web tokens and maps. To try and make me pay an extra $7.20 and then stick me with the more expensive set.
I'm sending an E-Mail now about the damaged Toxin and Venom. I'm gonna bring up the Daken dial problem but know that's a factory error. At this point I'd like to hear the explanation.
Thanks to everyone for the support and advice. I was made but wasn't sure who had the moral highground. I really thought buy it now would have cancelled out my offer if she had 0 or 10 items left. each new offer cancels the old one. I thought buy it now would do that. She didn't accept until after I bought the set which irks me too. If I was the seller and saw someone bought the set I'd confirm they wanted two.

Yeah even though I always pay immediately I rarely see my feedback until I leave feedback. As a buyer what more do I have to do to warrant feedback but pay promptly?

I always leave feedback when someone pays me for an item, but you can probably see in this case that the seller wanted to wait a bit.

Regardless of how it happened, things got screwed up when you put in a Best Offer and Buy-It-Now at virtually the same time. The smart seller would have made sure you only wanted one, and not both, and then cancelled the unwanted transaction (in order to get the $7 FVF back).

If I were you, I would just forget this transaction entirely, including feedback and get rid of the extra set of stuff you didn't want, by trading or selling it locally.

A lot of the LE figures have bent cards, so that is not a surprise. I would again say that those prize support figures shouldn't even be available to buy on eBay as a full kit, but since there are about 30 sets or more being sold currently, well.... :(

The one thing you could do, is email the seller, and ask about the extra 7 dollars you were charged for shipping. See if you can get a refund for that. Otherwise, I'd just let it go, don't leave feedback, and never buy from that seller again. :)
