I am sorry, I wasn't aware of the enormous legalities involving this sort of thing, and I apologize to all parties I have offended/insulted. Please disregard my ingorance on this subject matter.

Clix made to represent a copyrighted character cannot be sold.

On ebay it can't, but through email there's nothing stopping it.

Nothing except personal ethics, that is. And the fact that anyone caught doing this is putting themselve in danger.

In the community for the 3D character modelling and animation progam Poser, there was a site called "The 3-D Comics Collective". There, they gave away files that could turn the Poser People into their favorite superheroes - textures, props, clothing, etcetera. DC Comics officially said that not only did they care, that they thought it was good publicity. On the other hand, if they started SELLING these characters, they would be sued to the fullest extent of the law.

I should note that, while the site is now called Animotions, they still have nearly 500 different characters available for download for Poser users... and even some artists who are part of the DC Stable are members, and Darryl banks (former green Lantern artist) once assisted in creating a character for the free archives (Juggernaut, to be exact).

I should also note that someone tried selling a "Spiderman" mesh for a different program on another site. He was sued, and ended up being driven out of business.

I don't want to see anyone in this community get into legal trouble. If you're going to do something like this, keep it below board. Personally, I would not do it at all, if i make a copyrighted character for someone else it's gotta be a freebie based on their own clix, but that's just me.

actually while selling a clix of a copyrighted character is prohibited.... contracting your time is not!

All someone has to do is "contract" their time to make the said custom figure and they can then charge whatever they please for their time and matierals used.

Also, Ive got this nice Rookie Thug for sale for $x.xx .... and I will throw in this free custom "such and such" figure.

Yet another way to get around the law... give the custom away for free, but charge what you want for the rookie thug.

True, true.

But, again, I won't do that. Someone else could do it, and legally get away with it, but I'll say again:

If someone wants me to make them a mod, they supply the base figures, I supply the knife, putty, paint, and time. No money changes hands. And I only do it for friends.

What if you create a custom of an existing figure nad put it on that said figures base, but used a diferent figure to make the custom

IE: Use Nightwing or Toad to make a Spiderman figure. but put it on R/E/V base.

is that allowable?
